B.C.’s independent investigator into police actions that result in serious injury or death says charges may be appropriate against two Surrey officers over how they handled a report of a suspicious car last summer.

The Independent Investigations Office of B.C. (IIO) filed a report late last week with the B.C. Prosecution Service over the incident, which led to a crash that left the driver with serious injuries, on June 18, 2023.

The officers, one with the Surrey Police Service and the other with the Surrey RCMP, were called at 8 a.m. that day about a green Hyundai Elantra in the 100th Avenue parking lot of Green Timbers Urban Forest.

“The Hyundai was subsequently involved in a collision at the intersection of 100th Avenue and 140th Street,” read a statement from the IIO. “The male driver of the Hyundai was taken into custody shortly thereafter and transported to a hospital, where he was found to have sustained injuries.”

The IIO said it is not releasing further details to avoid prejudicing a potential criminal trial.

However, the IIO said chief civilian director Sandra Hentzen looked at the evidence and “determined that reasonable grounds exist to believe that two officers … may have committed offences related to grounds to pursue and driving offences.”

Prosecutors must now assess the IIO report and decide whether to press charges. That decision is based on whether “there is a substantial likelihood of conviction based on the evidence gathered by the IIO, and that prosecution be required in the public interest.”
