Relatives of alleged murder victim Kyle Schuiling who might have hoped to see his accused killer left court Monday disappointed.

Defence counsel Kirsten Lancee appeared on behalf of accused killer Christopher Stack in connection with the discovery of Schuiling’s body near a burned-out field west of the city in early April.

Lancee, appearing as agent for lawyer Andrea Urquhart, said that while Urquhart had received a certificate from Legal Aid to represent Stack, she can’t take the case because of a conflict between the lawyer and Schuiling.

As a result, defence counsel Tonii Roulston will be taking over the file and Lancee asked Justice Jim Ogle to adjourn the case for two weeks so the lawyer can review initial disclosure and seek further materials from the Crown.

“Ms. Tonii Roulston of our office does not have the same conflict as she does not know the victim,” Lancee said.

The Calgary Court of Justice judge ordered Stack detained on the murder charge. Because of his charge Stack can only seek release on bail in Court of King’s Bench.

Following the brief court appearance three members of the deceased’s family declined to comment on the case.

Stack, 39, was arrested by Mounties earlier this month and charged with first-degree murder in the death of Schuiling.

He was on release on other charges, including three counts of possession of stolen property and failing to comply with probation at the time of his arrest.

Schuiling’s remains were found April 3 by Tsuut’ina firefighters while battling a grass fire near Hwy. 8 and Range Road 40 in Rocky View County, about 12 kilometres west of Calgary.

Schuiling’s Facebook page stated he worked as an oilpatch roughneck, was living in Vancouver and had studied addictions counselling at a Calgary career college.

Prior to Stack’s arrest, Schuiling’s family had released a photo of him in the hopes it would assist investigators.

A cause of death has not been released.

Stack’s case is back in Calgary Court of Justice on June 10.
